END USER LICENSE AGREEMENT (EULA) & TERMS OF SERVICE – LOUP FRÈRES
This End User License Agreement ("Agreement") is a binding legal contract between you ("User") and Patryk Kamil Przebieracz, operating under the trade name "Loup Frères" and the pseudonym "Saint Aurelius" ("Provider").
- Definitional Isolation, Local-First Architecture, & Character Management
The software ("Application") is strictly defined as the localized user interface, local prompt-processing engine, and localized asset management system. It functions as a strictly local, text-generative narrative engine. It does not host, synchronize, or store your narratives, characters, or user logs on any central server.
The Application allows for the management, exportation, storage, and exchange of character cards and user logs. Because the Application is entirely local, any user-to-user exchange of these exported files occurs completely outside the Provider's infrastructure. The Provider claims no ownership of, and assumes no liability for, the unauthorized distribution of copyrighted material or illegal content exchanged directly between users.
The Character Kitchen Exception: The Application includes an optional, in-app catalog named the Character Kitchen, through which users the Provider has invited ("Chefs") may voluntarily publish character and world files for other users to browse and download. A file a Chef publishes to the Character Kitchen is the one exception to the local-only architecture described above: the file, together with the preview images and page text derived from it, is transmitted to and stored on infrastructure operated for the Provider by Cloudflare, Inc., and is distributed from there to other users of the Application. Nothing is published unless a Chef chooses to publish it. Browsing and downloading from the Character Kitchen transmit none of your own narratives, characters, or user logs; what they do transmit is described in Section 3 of the Privacy Policy. A file downloaded from the Character Kitchen is provided for your personal use within the Application.
- Perpetual Base License, Subscriptions, & Platform Variances
By downloading the Application, the Provider grants you a non-exclusive, non-transferable perpetual license to use the specific version of the Application you downloaded (e.g., version 1.0.0) in its current state. You own this local copy indefinitely.
Patreon Subscriptions: Your Patreon subscription provides a License Key that functions strictly as an Update and Authentication Key. An active subscription entitles you to authenticate your devices and download future software updates. If your subscription is canceled, you retain the permanent right to use the specific version you previously downloaded or updated to, but your Key will be deactivated, and you will lose access to all future updates.
Third-Party Storefronts (e.g., Steam): If you acquire the Application through a third-party storefront, updates, device limits, and ownership verification are governed natively by that storefront's Terms of Service. Due to differing platform guidelines, the feature set of the Application may vary significantly depending on where it was acquired. The Provider is under no obligation to achieve feature parity between different storefront releases.
- "Bring Your Own Key" (BYOK) Multi-Provider Architecture & Outage Protection
The Application acts solely as a localized narrative engine and inherently relies on a "Bring Your Own Key" (BYOK) architecture. The Application does not include, bundle, or supply any generative AI capacity of its own; it is a local front-end that connects to whichever third-party AI provider the User chooses to configure.
Supported Providers: The Application is provider-agnostic and supports connection to a range of third-party services, including but not limited to Google Gemini, OpenAI, Anthropic (Claude), OpenRouter, and NanoGPT, as well as user-defined custom OpenAI-compatible endpoints. You are strictly responsible for independently obtaining your own API key for each provider you elect to use, for covering any and all usage costs billed by that provider, and for reading and complying with each chosen provider's own Terms of Service, Acceptable Use Policy, and Privacy Policy. Your relationship with each AI provider is solely between you and that provider; the Provider of this Application is not a party to it.
Custom and Self-Hosted Endpoints: The Application permits the User to direct generation to an arbitrary custom OpenAI-compatible endpoint of the User's own specification. The Provider does not vet, validate, control, or endorse any such endpoint, and assumes zero liability for data transmitted to, or content received from, a destination the User has chosen to configure. The User bears sole responsibility for the trustworthiness, legality, and security of any custom endpoint they enable.
Knowledge-Graph Embeddings: For the Application's local knowledge-graph and memory features, text embeddings are generated by a third-party embedding provider which the User selects independently of the provider used for chat generation. Google Gemini is the default. The User may instead direct embeddings to any other supported provider, or to a custom OpenAI-compatible endpoint of their own specification. Use of the embedding feature therefore requires a valid API key for the selected embedding provider and is governed by that provider's terms in the same manner as any other provider. Embedding generation always transmits data to a remote service; it cannot be performed locally.
The Local LM Exception: A further exception to any reliance on remote providers is localized, offline generation via a Local Language Model (Local LM). To utilize this feature, the User must independently procure, install, and configure their own local backend software (e.g., Ollama, KoboldCPP) and legally obtain the necessary LLM weight files. Generation performed entirely through a local backend transmits no prompt data off the User's device.
Disclaimer of Local Liability: The Provider assumes zero liability for hardware degradation, system instability, or content generation resulting from the use of a Local LM. The User is entirely responsible for ensuring their hardware can safely run said models, and must comply with the respective Terms of Service, end-user licenses, and copyright restrictions of their chosen backend provider and downloaded LLM files.
Failure to Procure is Not a Defect: You are strictly responsible for registering, providing, and maintaining a valid API key for at least one supported provider (or a correctly configured local backend), as well as covering any associated usage costs billed by that provider. Your failure, refusal, or inability to procure, configure, or maintain a valid key or backend does not constitute a "lack of conformity" or a defect of the Application, and the Provider assumes no liability for an inoperable state resulting from a missing, invalid, expired, or misconfigured key or endpoint. The Application is delivered in conformity as a front-end; supplying the generative capacity to power it remains the User's sole responsibility.
Disclaimer of Third-Party Liability: The Provider exercises absolutely zero control over any third-party AI provider the User may select. You explicitly acknowledge that if a provider alters its API architecture, changes its pricing, revokes your personal access, experiences server outages, or ceases operations, the generative features of this Application that depend on that provider will cease to function. Under Directive (EU) 2019/770, the Provider is not liable for the failure of extrinsic, third-party digital environments. Any third-party API outage, deprecation, model retirement, or token exhaustion constitutes an external environmental failure entirely outside the scope of this sales contract, and does not constitute a "lack of conformity" or a defect of the Application. Therefore, third-party API failures do not grant the User the statutory right to demand a refund or terminate this Agreement.
- Device Limits & Breach of Contract
Your License Key is strictly personal property and authorizes you to authenticate updates on a maximum of three (3) of your personal devices. You are explicitly prohibited from sharing, reselling, or publicly posting your License Key, and from redistributing the Application binaries.
Reinstallation and Hardware Changes: The Provider recognizes that legitimate hardware formatting or software reinstallations may cause a Device UUID to reset. Users who reach their device limit due to standard hardware changes or formatting may contact customer support to request a manual reset of their active device count.
However, any evidence of unauthorized sharing and redistribution constitutes a direct breach of this Agreement. In the event of an abusive breach, the Provider reserves the right to immediately and irreversibly invalidate your License Key and issue a permanent ban without a refund. You will retain your software in the exact state it was prior to the termination.
- Eligibility and Age Requirement
By downloading the Application and activating a License Key, you represent and warrant that you are at least 18 years of age. The major third-party AI providers compatible with this Application generally prohibit the use of their API services by minors. Use of this Application by anyone under the age of 18 is a direct violation of this Agreement and of the applicable third-party terms. Because of the nature of third-party AI dependencies, we do not recognize "parental consent" as a valid workaround. If we have reason to believe you are under the age of 18, we will immediately revoke your License Key without a refund.
- Waiver of the Right of Withdrawal
Within the European Union, consumers generally possess a 14-day statutory right of withdrawal to cancel a distance contract. However, by accepting this Agreement and initiating the download of the digital Application, you provide your express prior consent to begin the performance of the digital delivery and explicitly acknowledge the permanent loss of your right of withdrawal.
In accordance with Polish consumer protection amendments mandating the implementation of a "Withdraw from contract here" button by June 19, 2026, this interface element may be present on our distribution platforms. However, any attempt to execute a withdrawal for the digital content via this button after the aforementioned waiver has been executed will be legally voided and rejected.
Third-Party Storefront Exemption: Where the Application is purchased or licensed via a third-party storefront (e.g., Steam), the statutory refund, withdrawal, and return policies natively mandated by that specific storefront shall completely supersede this Section.
- Acceptable Use Policy (AUP) for Text-Based Generation
The Application must not be used to generate or facilitate illegal or severely harmful text-based content. Based on standard AI provider regulations, the User is strictly prohibited from utilizing the Application's generative capabilities for the following:
The generation of text-based Child Sexual Abuse Material (CSAM), grooming materials, underaged sexual or violent content, or content promoting self-harm.
The synthesis of malicious code, malware, adware, trojans, or automated phishing and social engineering scripts.
The generation of mass disinformation or the fabrication of fake product reviews.
Reactive Enforcement: Because the Application is entirely local and unmonitored by the Provider, enforcement of this Acceptable Use Policy is strictly reactive. The Provider does not proactively monitor, log, or intercept your private generations. License revocation under this AUP will solely occur upon: (a) receipt of substantiated third-party reports regarding the User's public distribution of prohibited content, (b) the User publicly sharing or broadcasting the prohibited content, or (c) any AI provider independently revoking the User's API key for violations of that provider's respective Terms of Service.
Character Kitchen Content Policy: A file published to the Character Kitchen is public distribution. In addition to the prohibitions above, a Chef must not publish: sexual content involving minors, including fictional characters presented as minors; sexual content depicting a real, identifiable person without that person's consent; content that infringes another party's intellectual property or that the Chef has no right to distribute; content that is unlawful in the Republic of Poland or in the European Union; or adult content that is not marked 18+, which marking must cover the whole of the file, including every image it carries. The Provider does not review files before they are published. Every page in the Character Kitchen carries a Report control through which any user may notify the Provider of content they believe violates this Section; notices may also be sent to the contact address in the Privacy Policy. On receiving a notice the Provider reviews the content and may hide or remove it; the Chef is informed of the reason through the Application. A Chef whose published content is removed under this Section more than once may have their publishing privileges withdrawn, and a serious or repeated violation is a breach of this Agreement under Section 4.
- EU AI Act Transparency Obligations
Under Article 50 of the EU AI Act, transparency obligations dictate that natural persons must be informed when they are interacting with an AI system. If the User chooses to export, publish, distribute, or broadcast the synthetic text generated by the Application, the User bears the sole statutory responsibility for disclosing its artificial nature to third parties.
- Intellectual Property and Copyright
Under current European Union law, including established jurisprudence from the Court of Justice of the European Union (CJEU), works generated fully autonomously by artificial intelligence without sufficient human intellectual input are generally excluded from copyright protection. The Provider makes no warranties regarding the copyrightability of any text or narratives generated. The User assumes total, indemnified liability for any intellectual property infringement resulting from their specific prompts.
Character Kitchen License Grant: By publishing a file to the Character Kitchen, a Chef grants the Provider a non-exclusive, worldwide, royalty-free license to host, store, reproduce, generate preview images and page text from, display, and distribute that file and the previews derived from it to users of the Application, for as long as the file remains published. The Chef retains whatever rights they hold in the content. The Chef may end this license at any time by unlisting or deleting the entry within the Application, after which the Provider ceases distribution, save for copies other users have already downloaded. The Chef represents and warrants that they hold all rights necessary to grant this license, that the file complies with Section 7, and that its 18+ marking accurately describes the whole of its contents. Users who download a Chef's file receive it for personal use within the Application and acquire no further rights in it from the Provider.
- Reverse Engineering and Interoperability
The User shall not reverse engineer, decompile, disassemble, or derive the source code of the Application. However, users residing in the European Economic Area (EEA) retain the statutory right to decompile the software strictly to the extent necessary to achieve interoperability with an independently created computer program. Before commencing any decompilation for this purpose, the User is legally required to submit a formal written request to the Provider to supply the necessary interface information.
- Limitation of Liability & Indemnification
To the maximum extent permitted by applicable law, the total cumulative liability of the Provider shall be strictly limited to the amount actually paid by the User for the Application. However, in compliance with Article 473 of the Polish Civil Code, nothing in this Agreement shall limit, exclude, or restrict the Provider's liability for intentional misconduct or gross negligence.
You agree to indemnify, defend, and hold harmless the Provider from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Application, your violation of this Agreement, or your violation of any third-party rights (including any AI provider's Terms of Service regarding API usage).
- Right to Modify Terms
The Provider reserves the right to modify or amend this Agreement at any time to reflect changes in our software, third-party dependencies, or legal obligations. When updates are made, we will provide reasonable notice. Your continued downloading of subsequent software updates after such modifications have been published constitutes your explicit acceptance of the revised EULA.
- Severability & Entire Agreement
If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remainder of this Agreement shall otherwise remain in full force and effect. This Agreement, alongside the Privacy Policy, constitutes the entire agreement between you and the Provider regarding the Application.
- Dispute Resolution and Jurisdiction
Any disputes arising from this Agreement shall be governed by the laws of the Republic of Poland.
B2C Consumers: In accordance with Article 18(1) of the Brussels I bis Regulation, consumers may bring proceedings against the other party in the courts for the place where the consumer is domiciled.
Alternative Dispute Resolution (ADR): The Provider explicitly declares that it does not consent to, and is not obligated to participate in, out-of-court alternative dispute resolution proceedings to resolve consumer disputes unless mandated by statutory law.
